Ohio EPA Tightening Regulation of C&D Landfills

The Ohio EPA has introduced new more stringent rules for construction and demolition debris (C&DD) landfills that would require synthetic liners for the first time at new or expanded landfills handling the waste. The rules would also require more extensive groundwater monitoring at wood waste and other inert material dump sites. Ohio C&DD landfills collectively accept about 7 million tons of debris annually, 40 percent of which originates out-of-state from the east coast and Ontario, Canada. Some landfill owners argue that the new rules would significantly increase their costs and consequently drive some operators out of the market. Ohio EPA officials say that the new rules are needed to protect the environment and public health as originally required by the Ohio General Assembly in 2005. The agency published initial draft rules in 2006, but public response forced the agency to conduct additional studies and make revisions.

New Construction and Demolition Debris Facility Rules - Interested Party Review
The Division of Solid and Infectious Waste Management is in the process of conducting a review of the regulations for new C&DD facilities. The draft rules create a new Administrative Code chapter solely for regulations of new C&DD facilities. Rules applicable to new C&DD facilities will be found in Chapter 3745-520.

The Division of Solid and Infectious Waste Management (DSIWM) has drafted the C&DD Rules for new facilities and associated multi-program rules which can be found on the division's draft rule page.

Please note that as part of the rules that apply to new C&DD facilities, several "multi-program chapters" were created. These multi-program chapters consolidate requirements, such as licensing and ground water monitoring, that apply to many different solid waste facilities, including new C&DD facilities. Since these new rules are relevant to new C&DD facilities, they are being released at the same time to give stakeholders and opportunity to review them. Two of the six of the multi-program chapters, OAC Chapter 3745-500 – General administration and OAC Chapter 3745-501 – Licensing, were released with the interested party draft of the composting rules, and are made applicable to C&DD by these draft rules.
