Virginia Supreme Court Dismisses Case against SPSA

The Virginia Supreme Court dismissed a private landfill owner's case against the Southeastern Public Service Authority. The privately owned landfill run by John C. Holland Enterprises Inc. handles construction waste. In 2003 SPSA entered into the construction waste business. At issue was whether SPSA had to make public findings before entering into the construction waste business. The ruling hinged on the definition of the word 'system.' Public findings are necessary if a company is starting a new waste disposal system. The court found that SPSA had already created a waste disposal system and was merely adding a service, so no new findings were deemed necessary.
