Supreme Court Declines To Hear Case on Whether W.R. Grace Must Pay $54 Million Asbestos Clean Up

The Supreme Court declined to consider whether W.R. Grace & Co. must pay $54 million to clean up asbestos in the Montana mining town of Libby. The case represents a struggle between Grace which operated a vermiculite mine for 27 years and the US EPA which oversees the federal Superfund program. In the case, "W.R. Grace & Co., et al, v. U.S., 05-1363," Grace argues that the US EPA lacks the authority to assign the entire cost of the cleanup and future costs to them, citing other appeals court rulings. The administration argues that the EPA was within its bounds to seek the remedy.
