Public Disclosure of Dairy-Waste Plans

Date: August 28, 2006

Source: Idaho Supreme Court

The Idaho Supreme Court ruled on Monday, August 21st that the state Department of Agriculture must fill public-records requests for some dairy-waste plans filed with the Department by feedlot operators, even though the plans already had been returned to the feedlot operators. Other dairy-waste plans were ruled exempt from public-records requests. These were found exempt because feedlot operators had filed the plans through the Idaho OnePlan computer format. The state legislature created an exemption to public disclosure for information filed through OnePlan.
