Bedford, VA Girds for Eminent Domain Battle Over Old Landfill

A landowner in Bedford Virginia claims that the city is using the threat of eminent domain to force him to drop his $2.5 million lawsuit against the city. In that lawsuit, landowner Mike Schrock claims that the city's now closed landfill, that operated from 1960 to 1994, has damaged his 44-acre property and business operations. Shrock believes that the city's initial offer of $300,000 did not constitute a bona fide offer that is a prerequisite to the exercise of eminent domain or condemnation. The city believes that it must acquire the property to insure adequate environmental protection.
