Pennsylvania Supreme Court Upholds Landfill Regulations

The Pennsylvania Supreme Court has upheld regulations of the state Department of Environmental Protection requiring landfill operators to demonstrate that proposed landfill construction or expansion will prove more beneficial than problematic. Two landfill operators had argued that the "harms-benefits test" was beyond the authority of the state, but the court disagreed.
