Mass. Supreme Court Considers Landfill Expansion Approval

The Massachusetts Supreme Court (www.mass.gov/courts) is considering arguments regarding a landfill expansion in Granby involving a state regulation designed to protect nearby residents. Local residents are suing the Granby Board of Health and the landfill's owner, Holyoke Sanitary Landfill Inc. The state Department of Environmental Protection and the health board approved the vertical expansion despite a state law that bans landfill expansions within 1,000 feet of occupied homes, except in the case of coal ash. The state ruled that the expansion actually falls under the heading of "major modification" and thus does not need to comply with the setback.
